Paper Abstract:      In almost all developing countries, and given the reality of today’s competitive socio-economic scenario, societies appear to be divided between those who are 'in' -included- and 'out of’ -either excluded or not included- Information Society. Among Latin American Small and Medium Companies’ entrepreneurs and other social actors, staying 'out' seems, at a first sight, to be a consequence of the digital divide. However, to move ‘in’ IS also demands a rational decision vis a vis legal requirements, specially those related to document records and registers. On the other hand, since survival of social actors depends everyday more and more on being ‘in’ IS, law should be used as an Information Society inclusive factor, by means of stating easier and cheaper requirements and, in so doing, pave the way for companies which decide to walk 'in' IS.
