Paper Abstract:      Knowledge transmission and science communication is a core activity of overall high education institutions. However very complex legal, technical and socioeconomic aspects are commonly faced by educational institutions requiring identify and address what is Intellectual Property (IP), who can own the products of knowledge, and how to manage it. Academic field has a special exception at copyright law recognized as “fair use” that is commonly used but sometimes is misunderstood arising some troubles between owners and users. Technological measures enabling the enforcement of appropriate rights management mechanisms are under a huge discussion creating the opportunity to appear two different directions on rights management: the open access movement and the rights protection and management approach. In this paper, the most important issues concerning IP and factors affecting both of the above mentioned directions are presented and how can affect the science knowledge creation and transmission. Also, we identifies and discuss the implications that the usage of rights management solutions have in some academic sectors like e-education and digital content libraries and some obstacles on science dissemination that can cut a real acceptance of some technological.
